Alpa service srl leases to the customer the vehicle indicated on the front of this rental contract under the terms of the contract set out below and fully viewable on the site https://www.alparent.it under the heading “Rental Service” “Contract of rental “and also refer to the” General Terms and Conditions “contained under the heading” Rental Service “on the website https://www.alparent.it in full.
A) Insurance coverage (RCA) and equipment
Alpa service srl vehicle insurance includes civil liability towards third parties (RCA), as required by the law in force in the country where the car is registered. The vehicle is delivered with a sealed odometer, tools, triangle, spare wheel or repair kit. The electric and hybrid cars in the Leasys Rent fleet can be equipped with a standard domestic charging cable (3KW), a type 2 cable (22 KW) and an RFDI Card EnelX charging card, whose theft, loss, damage and \ or tampering will result in the application of the related penalty, as better specified in the Terms and Conditions document on the website https://www.alparent.it.
B) Delivery and return of the vehicle
The rental begins on the day and time of delivery of the vehicle to the Customer and ends on the day and time of the return of the vehicle to Alpa service srl The vehicle is delivered in perfect condition and must be returned in the same conditions in which it was delivered (except for normal wear and tear), at the Alpa service srl offices on the day and at the time indicated in this Rental Agreement. The Customer is obliged, upon return, to request the signature of a Leasys Rent employee on the Check-in report which shows the actual state of the car and the fuel level and for electric or hybrid vehicles also the presence of the charging cables, as well as the return of the EnelX RFDI Card. In the absence of this signature, the determinations documented by Leasys Rent will be valid and tacitly accepted. If, at the time of delivery, damage is found on the vehicle, the Company will inform the customer by sending the photos and the relative appraisal issued by an independent certification body by e-mail, inviting the customer to provide your own considerations. Leasys Rent, unless the customer proves that the damage is derived from a cause not attributable to him as provided for by Article 1588 of the Civil Code, will then charge the penalty pursuant to letter F of this contract through the credit card of the customer. If the vehicle needs a particular cleaning and / or sanitizing treatment due to the conditions in which the Customer has returned the car, Leasys Rent will proceed to charge for the extra washing, documenting and communicating the charge in advance. The vehicle must be returned to the rental center on the date scheduled in the booking. If the Customer wishes to change the terms of the return (place, date, time) he must obtain the prior written consent from Alpa service srl by making a request to the latter at least 24 hours before the date established for the return. In the absence of authorization, once the 59-minute tolerance for return has been exceeded with respect to the scheduled date and time, the extra days will be billed at the highest Standard daily rate published in the price lists in force, and also in the event of the vehicle being returned to a rental, in the Italian territory, other than that provided for in the booking and not authorized by Leasys Rent, a penalty will be applied, without prejudice to the contractual conditions established by letter T of this rental agreement. In no case can the vehicle be returned outside the Italian territory.
If, at the time of returning the vehicle, the keys of the same are not returned, due to loss or for any other reason or if they are returned damaged and / or tampered with, the customer is required to pay a contractually established penalty, unless he proves that the damage is derived from a cause not attributable to him as provided for by article 1588 of the civil code. The same penalty will also be applied in the event of loss and / or deterioration of the license plate.
C) Rental guarantee by financial credit card
The Customer, signatory of the contract (first driver), is required to provide a financial credit card to guarantee the rental service. To this end, a security deposit will be required by authorization on the same credit card. The amount of the deposit will be equal to the amounts specified in the Terms and Conditions document on the website https://www.alparent.it. This amount will be compensated, in whole or in part, with the sums due to Alpa service srl by way of payment for the rental pursuant to the following paragraph H. In such cases, the Customer authorizes as of now the use of his card. credit as the only contractual payment instrument envisaged. For the Leasys Car Cloud subscription service, the customer, signatory of the rental agreement, must provide a credit card in his name in order to allow the acquisition of a security deposit of € 1 in order to confirm the validity of the aforementioned instrument. of payment. In any case, cash, debit cards, debit cards, Visa Electron, prepaid or rechargeable cards are not accepted.
D) Vehicle maintenance
The Customer undertakes to use the vehicle correctly and diligently and will be liable for any damage caused to it, unless he proves that the same damage is derived from causes not attributable to him, as required by 1588 cc The Customer, for Diesel vehicles who are equipped with it, has the duty to refuel the car with the AdBlue additive, moreover the Customer is required to regularly check the levels of engine oil, coolant and brake fluid and in any case, every 1000 kilometers of mileage. The costs of hospitalization, washing and punctures of the tires are charged to the customer. Oil and greasing due to normal wear and tear will be reimbursed only on presentation of regular receipted invoices (indicating the date, name and address of the supplier, the vehicle license plate and the kilometers traveled) in the name of Alpa service srl, subject to prior authorization. Leasys Rent. During the winter, when low temperatures occur and in any case in mountainous areas, the customer is required to mix the fuel with the antifreeze additive and to hospitalize the car in a covered place, otherwise he will be held economically responsible for the damage caused by such negligence. In the event of a breakdown, the Customer will contact the Leasys Rent Assistance service and will contact the nearest Alpa service srl rental center for assistance and / or any replacement of the vehicle. If the intervention of the roadside assistance or the mechanical breakdown is attributable to the fault of the customer, the latter will also be required to reimburse Leasys Rent the cost for the intervention of the roadside assistance.
E) Use of the vehicle
The vehicle may be driven by the Customer or, if indicated on the front of this Rental Agreement, by one or more drivers, as long as they are 21 years of age and in possession of a valid driving license issued for at least 12 months enabling them to drive the vehicle and other valid identity document. For the Leasys Car Cloud subscription service it is sufficient that the customer has a valid driving license for at least one year, a tax code and a valid identity document (identity card and / or passport). Driving licenses printed in characters other than the Latin alphabet (Arabic, Chinese, Japanese, Cyrillic, etc.) must be accompanied by an international driving license. Furthermore, it is specified that Alpa service srl reserves the right not to provide the car if it considers the documents presented by the driver insufficient. The vehicle cannot be driven by other persons other than the contract holders, unless previously authorized in writing by Alpa service srl Any infringement of the rules of the Highway Code will determine for the customer an irregularity in the correct fulfillment of contractual obligations and the application of the relative penalties. The customer, under penalty of total responsibility, must take delivery of the property and observe the diligence of the good father of the family in using it (pursuant to art. 1587 and art. 1176 of the civil code) and in any case it cannot be used for:
a) the illegal transport of goods (smuggling, drugs, dangerous goods etc.);
b) the transport of passengers for a fee expressly or tacitly agreed;
c) illicit purposes, for speed competitions or track tests or races of any kind;
d) go abroad except in cases previously authorized by Alpa service srl;
e) purposes of sub-rental and / or careless reliance on third parties for any reason whatsoever.
f) driving under the influence of alcohol or drugs, in a state of unconsciousness, in abnormal psychophysical conditions and / or in
contrast with the rules of the Highway Code.
For the sake of the driver’s safety and the correct maintenance of the vehicle, Leasys Rent reserves the right to consider the improper and / or abnormal use of the vehicle in case of exceeding the maximum mileage parameters provided for by the different rate profiles chosen by the customer. In the event of a kilometer excess beyond what is foreseen by the purchased rate, Leasys Rent reserves the right to apply a specific rate charged to the customer which varies according to the car group rented. In any case, Alpa service srl reserves the right to take action for greater damages.
F) Basic services and optional services CDR Basic Service * Damage:
CDR service is included in all published Alpa service srl rates, conventionally considered equal to 22% of the applied rate. The CDR service is not an insurance coverage, but a conventional reduction of the Customer’s liability for damage found on the car during the rental including those from circulation, i.e. damage to the rented vehicle resulting from accidents involving at least one other vehicle or without a counterpart . The conventional reduction of liability takes place within the limits of a maximum amount chargeable per event which varies according to the car group rented from a minimum of € 1200.00 to a maximum of € 3500.00 as better specified in the Terms and Conditions document on the site. https://www.alparent.it. The CDR service does not include damage caused to: windows, roof, underbody, wheels, interiors and those resulting from vandalism.
TP Base Service * Theft:
All published Alpa service srl rates include the TP service, conventionally considered equal to 18% of the rate applied. The TP service is not an insurance coverage, but a conventional reduction of the Customer’s responsibility in the event of total / partial theft or fire within the limits of a maximum amount due by the customer which varies according to the car group rented from a minimum of € 2000, 00 to a maximum of Euro 5000.00 as better specified in the Terms and Conditions document on https://www.alparent.it.
TP Theft basic service exceptions:
The customer and / or driver remains fully responsible for the reimbursement of the total cost of the vehicle in the event of failure to return the keys. In the event of total, partial theft or fire of the vehicle in Campania, Puglia, Calabria or in the city of Catania and its province, Leasys Rent will not provide the Customer with a replacement car.
SUPER COVER * Optional Service Damage and Theft:
It is not an insurance cover. If requested and signed at the time of rental, it eliminates the amount owed by the Customer for damage and theft relating to the rented vehicle. The SUPER COVER service also includes damage to glass, roof, underbody, wheels, interiors and those resulting from vandalism and atmospheric events.
Optional service exceptions SUPER COVER Theft:
In the event of total / partial theft or fire of the vehicle occurring in Campania, Puglia, Calabria or in the city of Catania and its province, the Super Cover service does not completely eliminate the application of the penalty, but reduces the amount chargeable by way of 50%. penalty which varies according to the rented car group, as better specified in the Terms and Conditions document on the website https://www.alparent.it. Furthermore, in such cases, Alpa service srl reserves the right, at its sole discretion, not to provide the customer with a replacement car.
Optional G&T Service “Rubbers and Crystals:
It is not an insurance cover. If requested and signed at the time of rental, it eliminates the amount due
by the Customer for damages relating to glass and wheels only. However, those resulting from vandalism remain excluded
and atmospheric events.
* CDR, TP and SUPER COVER, G&T services do not operate:
in case of willful misconduct or gross negligence pursuant to art. 1229 of the Civil Code
in case of lack of diligence by the driver pursuant to art. 1176 and art. 1587 of the Civil Code in case of failure to return the keys and the vehicle
In these cases the Customer is fully responsible for the reimbursement of the cost of the vehicle after the exchange of documents between the parties regarding the event.
In such circumstances, Alpa service srl reserves the right not to supply the car, after evaluating the circumstances that have occurred.
G) Accidents, damages and claims
The Customer is obliged to notify Alpa service srl of any road accident or damage in writing within 24 hours of the event or upon return of the vehicle using the CAI form that will be found among the documents supplied with the vehicle or the Report Form. Accident, also having the investigations carried out by the competent authorities. Failure to comply with this obligation causes serious damage to Alpa service srl, therefore a penalty will be charged to the driver starting from € 500.00 (amount not subject to VAT) up to a maximum of € 2,000, 00 (amount not subject to VAT) as reported in the “General Terms and Conditions” paragraph “Extraordinary events” available on the website https://www.alparent.it in the “Rental Service” section. Any subscription to the Super Cover service does not exempt the Customer from this communication obligation. The customer is aware that the vehicle may be equipped with a satellite device enabled to collect vehicle usage data and road traffic accident data. These data will be processed and collected by the company that manages them and then transmitted to the vehicle insurance company and to the police.
H) The Customer undertakes to pay Alpa service srl by credit card
1. The rental fee calculated on the basis of the kilometer rate and the time rate;
2. The additional consideration due in the event that the vehicle is returned to Alpa service srl in a place other than that
delivery to the customer, calculated on the basis of the appropriate rate (one-time service);
3. The reimbursement of the cost of the refueling service equal to the one resulting at the time of taking over
of the vehicle. In particular, a fixed amount will be charged and, in addition, a lump sum amount, corresponding to the amount of missing liters calculated at a price higher than the market value. The above increases will be calculated on the basis of the specific tables published in the “General Terms and Conditions” paragraph “Accessory Services” available on the website https://www.alparent.it in the “Rental Service” section referring to the date of return of the vehicle;
4. The sums due in the case of subscription of SUPERCOVER, G&T and the sums due for the payment of the amounts pursuant to letters D, F and G and in general the damage reported to the vehicle, as well as any costs of opening the claim file;
5. Any airport, rail, traffic, taxes and administrative expenses;
6. An amount equal to the fines paid to the Customer and / or to Alpa service srl for violations of the rules of the Highway Code
o motorway tolls in relation to the use of the vehicle by the Customer, and at the same time he accepts the debit on the credit card of the fines notified after the termination of the contract relating to the rental period, as well as the related amounts as a penalty according to what provided in the Rental Terms and Conditions as well as by the letter “E” of this contract;
7. The reimbursement of all expenses and charges incurred by Alpa service srl to obtain payment by the Customer of the amounts due by the same;
8. Any penalty or additional cost that may be provided for by the “General Terms and Conditions” which can be viewed on the website https://www.alparent.it in the “Rental Service” section;
9. The amount corresponding to any other service that the Customer himself has used. The aforementioned charges will be made to the customer’s current account through the use of the financial credit card provided at the time of rental, in the manner prescribed by the institution issuing the card. The Customer who at the time of rental presents a prepaid voucher or makes a rental on behalf of another person (natural or legal person) is in any case jointly and severally obliged with the person who issued the voucher, to pay any amount deriving from the rental itself in case of total or partial insolvency on the part of the issuer. In the case of rental made in the name or on behalf of a legal person, the signatory of this rental agreement is jointly and severally liable with the aforementioned legal person for all the provisions of the contractual conditions expressed therein, by way of example, reference is made to cases of failure payment of: damages caused, embezzlement, fines etc.
Alpa service srl invoices relating to the above fees are payable on sight. In case of late payment, interest will be due on all amounts due to Alpa service srl at the official discount rate increased by 4 percentage points and in any case within the maximum limits allowed by current legislation, unless otherwise and more favorable provisions of the law governing matter.
10.The amount relating to the top-up service carried out by the customer through the RFDI Card on the EnelX public network or Enel X affiliated partners. In particular, an amount will be charged, corresponding to the amount of KW topped up, according to the methods indicated in the General Conditions ”paragraph“ Top-up services ”available on the website https://www.alparent.it“ Rental Service ”section;
11.The amount relating to each minute of parking after the sixtieth minute after the end of the charging session and up to the moment in which the connector is removed from the socket used in the event that it does not remove the car from the charging station stall within 60 minutes following the end of the vehicle charging session. The aforementioned amount will be calculated according to the methods indicated in the “General Terms and Conditions” paragraph “Parking after the completion of the top-up” available on the website https://www.alparent.it in the “Rental Service” section;
Without prejudice to the responsibility of the vehicle manufacturer for construction defects, Alpa service srl will carry out all routine maintenance activities in order to rent the vehicle in a good state of efficiency, guaranteeing its constant maintenance in relation to the agreed use, as foreseen. from art. 1575 cc.
L) Prohibition of assignment
The Customer undertakes not to transfer, sell, mortgage or pledge the vehicle, tools, equipment and any other part thereof and in any case not to act in conflict with the right of ownership on the vehicle of Alpa service srl
M) Replacement of the vehicle
Alpa service srl reserves the right not to provide a replacement vehicle in the event of an accident, breakdown, theft, damage or for any other reason at its sole discretion, without having to justify such refusal. Please note that a replacement car will not be provided following theft or fire in Campania, Puglia, Calabria or in the city of Catania and its province.
For any dispute arising from and / or connected with the rental of the vehicle, in particular for any action necessary for the compulsory recovery of the credit accrued by Alpa service srl, the court of Civitavecchia will be exclusively competent. This clause does not apply in the event that the rental owner uses the service for purposes unrelated to his professional or business activity (Consumer) as required by art. 33, paragraph 2, lett. u) of the Consumer Code.
Alpa service srl will in no case be responsible for the loss of objects that the Customer or third parties may have left or loaded on the car, during the rental period or after the return of the vehicle. Without prejudice to the foregoing, in the event of the discovery of goods inside the vehicle, the rental company undertakes to promptly notify the customer by providing, at the request of the customer, the shipment or to keep the asset available for a period of 30 days, after which the property will be considered abandoned.
In the event of a conflict in the interpretation of the two versions of this contract, the Italian version will prevail over the English one.
Any variation and / or addition to the rental conditions indicated here will be valid and effective only if made in writing.
R) Acceptance of the contractual conditions
The Customer, by signing this contract, agrees to rent the vehicle indicated at the price and under the conditions indicated therein and also authorizes Alpa service srl to debit the credit card issued for any relative amount due. The Customer also declares to have read the contents of the “General Terms and Conditions” available on the website https://www.alparent.it in the “Rental Service” section. Except for promotional activities, the customer is required to pay the rate for the vehicle group actually used.
S) Statements with express approval
Pursuant to and for the purposes of Art. 1342 CC and following The Customer declares to expressly accept the conditions referred to in letters: B, D, F, G, H, I, L, N, O, R, T as per separate signing on the front of the contract.
T) Statement of responsibility
The Customer and the driver declare that they are aware that in the event of failure to return the vehicle within the contractual terms, in the absence of any valid impediment (force majeure) they are responsible for the crime of embezzlement or possibly contractual fraud.
